---ov 00-06 (Beaver Butler) On appointing a special committee to explore amendments to the BOO to permit congregations which cannot comply with G-6.0106b to disaffiliate from the church while retaining real property.

---ov 00-40 (Milwaukee) on amending G-4.0403 and G-14.0201 to list sexual orientation as a category not to be excluded.

Constitutional Amendment via Commissioner Resolution

---"The Assembly Committee on Bills and Overtures recommends that the committee on the Office of the General Assembly review Standing Rule B.5.e. and E.4.c.(2) for consistency with G-18.0301a": APPROVED (The issue is whether to end the ability to propose a constitutional amendment in a Commissioners’ Resolution. Such resolutions were declined this year at the Stated Clerk’s recommendation. Standing rule E gives process details for handling constitutional amendment requests in Commissioners’ Resolutions. That section of the BOO doesn’t mention CRs as a means of initiating an amendment.)

Documents to Commissioners

---ov 00-30 (San Joaquin): availability of documents to commissioners. Overture required document to be MAILED to all commissioners along with the reports which reference them. The approved version only requires the documents to be MADE AVAILABLE.

APPROVED with AMENDMENT (to use COGA wording) by voice vote 1. Shall SR B.5.b. be amended by inserting a new sentence at the end of the second paragraph so that it reads as follows:

"Committees, agencies, or corporations presenting reports shall provide the appropriate background information necessary to interpret or understand the recommendations or responses to referrals to the members of the GA committees to which the business is referred. Any and all documents or publications referred to in these reports which require approval by the assembly for publication and distribution to the church, including but not limited to curriculum, study papers/guides, position papers, and program resources, shall be made available to commissioners at the time the reports are published."

Floor Nominations at G.A.

---12.045 adding to the Standing Rules a procedure for conducting elections when there is a nomination from the floor in addition to the GANC nominee. This procedure prohibits any questions or debate before the vote is taken. APPROVED on consent agenda. Amend Standing rule B.9. to read as follows:

"9. Nominating from the floor

a. When any nomination for service on a General Assembly committee, council, or board comes from the floor of the assembly, the commissioner making the nomination will provide the General Assembly Nominating Committee, at least twenty-four hours in advance of the nomination being made from the floor, with pertinent information about the person whose name is being presented, as well as the name of the particular person nominated by the nominating committee whose nomination is being challenged. Such information shall be provided on the "Nomination by Commissioner Form" provided for use at the assembly and available from the Stated Clerk.

b. In the event that there are nominations from the floor, the election shall proceed as follows:

(1) The General Assembly will deal with one challenged position at a time.

(2) The name of the General Assembly Nominating Committee’s nominee shall be placed in nomination by its moderator. The Moderator of the General Assembly shall call upon the commissioner who is placing a nomination from the floor to put that name in nomination.

(3) Once the names are placed in nomination, the order of speaking shall be first, the commissioner or a designee speaking on behalf of the floor nominee and second, the General Assembly Nominating Committee member or a designee speaking to its nominee. Both the commissioner (or designee) and the General Assembly Nomination Committee member (or designee) shall speak from the platform. Such speech shall not exceed three minutes in length. There shall be no other speeches seconding the nomination of any nominee.

(4) Without further discussion or debate, the General Assembly will move to vote."

GANC Reform Overtures

---ov 00-63 (Greater Atlanta) requiring GA Nominating Committee to submit report

120 days before GA. GANC told committee they had changed their procedures and would submit their report, including background info on nominees, 60 days before GA. Disapproved with comment: "That we commend the General Assembly Nominating Committee for its own work, prior to this assembly, to revise its procedures in the spirit and direction of Overture 00-19 and Overture 00-63." 397-156

Overture Advocates

---12.046-.047 Amend Standing Rule B.5.c (4) by adding the following: "In the event that the assembly refers an overture to a GA entity for further consideration (and not simply for implementation), the presbytery or synod submitting the overture shall be invited by the Stated Clerk to designate an overture advocate for the assembly meeting at which the entity’s response to the overture is presented. The overture advocate shall be available to provide information on the background and intent of the overture to any assembly committee to which the overture may be referred. (See Standing Rule C.4.d.)" APPROVED in consent agenda

---12.048 amend Standing Rule C.4.d. by adding to those who may speak in committee: "Overture advocates (see Standing Rule B.5.c.(4)) who have been designated by their presbytery or synod to speak to the response from a General Assembly entity to a referral of an overture shall be responsible for being available at the time selected by the assembly committee considering the response. The overture advocate shall be entitled to speak to the background and intent of the overture immediately after the motion is made and seconded, placing the response to the referral of the overture on the floor of the committee or subcommittee, or immediately after any motion that might logically be expected to affect the response is moved and seconded, and during debate of such motions to correct misunderstandings or to clarify." Overtures

---ov 00-76 (Baltimore)

1. Insert a fourth bulleted item to section B.5.c.(1) to read as follows:

Draft the overture in the following form:

"The Presbytery of _____ overtures the General Assembly of the PC(USA) to [state the specific action the General Assembly is asked to take]. "To this shall be appended a rationale, stating the reasons for submitting the overture."

2. Amend the third paragraph of section B.5.c.(2) to read as follows:

"In the event that the Stated Clerk of the General Assembly receives an overture similar to one already proposed (excluding the rationale), she or he shall inquire of the presbytery or synod in question whether it would be willing to concur with the existing overture or desires to withdraw the overture. A presbytery or synod concurring with an overture may submit additional rational for its action, provided that it does not duplicate the rationale provided by the overturing body. The concurrence and any additional rationale will be printed with the original overture in the Reports to the General Assembly." APPROVED in consent agenda

---11.013 accept invitation of Sheppards and Lapsley presbytery for 218th GA (2006) to be in Birmingham, Alabama from June 17 to 24, 2006, concurrently with the General Assemblies of the Cumberland Presbyterian Church and the Cumberland Presbyterian Church of America, subject to the Cumberland Presbyterian Church and the Cumberland Presbyterian Church in America adopting similar recommendations. APPROVED in consent agenda

---12.050-.051 Amend Standing Rule B.5.b to include:

"An entity, commission, or committee submitting a report with a recommendation that affects the work or budget of another entity(ies) shall submit evidence that a consultation has been held with the affected entity(ies)." APPROVED in consent agenda

---12.052 amend Standing Rule B.5.c(2) to include "Presbyteries or synods submitting overtures with a recommendation(s) that affects the work or budget of a General Assembly entity(ies) shall submit evidence that the affected entity(ies) has (have) been consulted. If such evidence is not submitted, the Stated Clerk shall recommend that the overture be received and referred to a future session of the General Assembly so that consultation may take place." Restricting Staff from Commissioner Area and Restricting Cell Phone Use

---ov 00-27 (San Joaquin) original overture would have restricted staff from restricted seating area for commissioners and advisory delegates and defined allowable uses of cell phones. APPROVED with AMENDMENT (COGA wording) in consent agenda:

Amend Standing Rule A.5.

"The only persons who shall be permitted access to the commissioner and advisory delegate seating area during plenary sessions are commissioners, advisory delegates, assistants enrolled by the Stated Clerk to assist commissioners having a disability warranting assistance, the Stated Clerk, Associate and Assistant Stated Clerks and other staff and assembly assistants who are assigned responsibilities that require access to this area, including assisting at the floor microphones, delivery [sic] official messages to commissioner and advisory delegates, and locating commissioners who are needed on the platform. The Stated Clerk will provide special credentials for the particular staff and assembly assistants who are authorized to enter the commissioner/advisory delegate seating area.

"Use of cellular telephones is prohibited during meetings of the General Assembly and meetings of the assembly committees. During these meetings, pagers may be used only in the silent mode.

"Emergency messages will be relayed to a commissioner or advisory delegate during plenary meetings by way of a written message delivered by one of the Stated Clerk’s designated staff or assembly assistants."

Demonstrations

---ov 00-28 (San Joaquin) on demonstrations. Amended wording was provided by the overture advocate and further amended in committee and on the floor to read as follows:

Amend Standing Rules by adding a new Item B.13. to read as follows:

"13. Peaceful demonstrations shall be allowed twenty-five or more feet outside of the entrances to the building in which General Assembly meets. Spontaneous or planned demonstrations by individuals or groups are prohibited inside the building where the General Assembly meets. The Moderator of the General Assembly shall declare all demonstrations that occur in plenary session out of order and, if demonstrators fail to immediately disband and desist, may recess the General Assembly to a fixed time and place. This rule does not prohibit the spontaneous or planned celebration of an action of the General Assembly or of any event in the life of the Church." APPROVED 368-149

Open Committee Meetings

--ov 00-29 (San Joaquin) On enforcing the one-hour limitation on closure of initial Assembly Committee meeting. Disapproved with comment on voice vote: "That we commend the Stated Clerk for enforcing standing rule C.4.f. and encourage continuation of enforcement."

YAD study

---ov 00-69 (Great Rivers) "refer to COGA for study and report to the 213th GA (2001) the ways in which Youth Advisory Delegates (YADS) participate in committees and plenary sessions of General Assemblies in order to bring about a more proportionate and appropriate participation of YADS relative to participation by elected Commissioners." APPROVED 397-115

Change G.A.s

---ov 00-87 (Synod of Rocky Mountains) elect commissioners for 2-year terms beginning in odd-numbered years. In odd numbered years GA would meet 3 days to elect moderator, receive reports, make budget adjustments and amend Standing Rules. In even-numbered years meet 7 days. Referred to COGA

TSADs

---11.003-.004 allow Fuller and Gordon Conwell to send TSAD each year. Amend Standing rule A.2.(d) as follows:

"All non-Presbyterian theological schools represented by corresponding members on the Committee on Theological Education and one additional non-Presbyterian theological seminary shall be chosen on a rotating basis, descending alphabetically from those that have at least twelve Presbyterian enrollees (either inquirers or candidates under the care of a presbytery) as of October 1 in the year preceding the assembly.

"Nominated students shall have at least one more year of study following the assembly remaining in their degree program. The Stated Clerk shall forward the name of the nominated students to the presbyteries of jurisdiction for election and confirmation." APPROVED in consent agenda

Minority Report Procedures

---11.010-.011 amend minority report procedure

Amend Standing Rule B.7.c. to read as follows:

"Minority Reports

c. In order to be considered by the assembly, a minority report shall not only set aside the majority report but also be able to stand as a full and complete substitution for the majority report recommendations. A minority report shall be moved as a substitute only after the majority report has first been moved. When this happens, the assembly shall first consider (and may amend) the majority report. When consideration of the majority report is completed, the assembly may then consider (and may amend) the minority report. Further efforts to perfect each report shall be held to a minimum in order that the assembly can concentrate instead on the issue of whether to make the proposed substitution.

"The moderator of the committee, or another member of the committee, shall present reasons supporting the committee’s recommendation. They may be presented before any minority report is moved or presented during the narrative report of the committee, or presented during debate on the question of whether or not the substitution shall become the main motion. (See also Standing Rule C.5.d.) APPROVED in consent agenda

---11.012 amend minority report procedure

Amend Standing Rule C.5.d. to read as follows:

"Minority Reports

d. A minority of the members of an assembly committee, or an individual member of an assembly committee, may submit in writing views that differ from those in the committee report. If the moderator of the committee shall affirm in writing that the positions expressed as recommendations for action by the assembly in a written minority report were presented to the whole committee during its consideration of the matter, the Stated Clerk shall reproduce the minority report and distribute it with the report of the committee.

"A minority report must be appropriate for consideration as a substitute motion (see Robert’s Rules of Order, Newly Revised, 1990, p. 520). (See also Standing Rule B.7.c.) APPROVED in consent agenda

Review Process for G.A. Agencies

---12.037 "charge the COGA with responsibility for developing and proposing language to be included in the Standing Rules of the General Assembly that reinstates the independent review process for assembly agencies and that the proposed language be presented to the 213th GA (2001) for approval." APPROVED in consent agenda

Communications from Special Organizations

---12.054-.054d eliminates the right of Special Organizations of Presbyterians to send communications to the GA by striking "by organizations that have no regular access to the General Assembly through established procedures" in the Standing Rules listing of who may send communications and replacing it with:

"(2) by organizations in which the Presbyterian Church (USA) holds membership, and

(3) by other denominations in correspondence with the General Assembly." APPROVED in consent agenda

Random Committee Assignments

---ov 00-31 (San Joaquin) had requested that random assignment to Assembly committees be done by a drawing open to observers. Action was:

1. That the overture be disapproved.

2. Amend Standing rule C.2.a. [by deleting the phrase "or by an alternate random process" so that the procedure defined in the Standing Rules is mandatory.] APPROVED 476-21

3. Church Polity

Revision of the Form of Government (Book of Order)

--12.053 "circulate the attached draft revision of Chapter XIV (Ordination, Certification, and commissioning) of the Form of Government in the Book of Order and invite widespread comment by presbyteries, synods, and GA entities." APPROVED with no objections

Membership Qualifications

--ov 00-60 (Twin Cities Area) clarify welcoming gay, lesbian, bisexual, and transgendered persons as church members. Overture had requested and committee had recommended adding "sexual orientation" so the phrase in G-5.0103 so it would read "No person shall be denied membership because of race, ethnic origin, sexual orientation, worldly condition, or any other reason not related to profession of faith." The wording was then amended on the floor. APPROVED to send to presbyteries with amendment 384-127:

"No persons shall be denied membership for any reason not related to profession of faith."

---ov 00-43 (Milwaukee) "fair play," requesting that "if the assembly wishes to concur with the 211th GA (1999) in delaying any legislative actions regarding G-6.0106b to the 213th GA (2001), there should be a concomitant delay in any related judicial actions." disapproved 384-96

---new business: That the following statement be adopted: "At the encouragement of the 211th GA, the 212th GA (2000) acted to refer items relating to G-6.0106b to the 213th GA (2001). We did that referral in a spirit of dialogue and understanding. In that same spirit, this assembly expresses its deep hope that all Presbyterians and their respective governing bodies will refrain from initiating any judicial actions with respect to the issue of sexual orientation until the response of the 213th GA (2001) is completed. We further express our deep hope that all Presbyterian and organizations advocating positions with respect to these issues will exercise similar restraint in their public statements and actions. The 212th GA (2000) directs the Stated Clerk to communicate this response to the church." APPROVED

---22.187-.228 Christian educators, referred to the GAC with amendment and with comment: "The 212th GA (2000) wishes to affirm the effort of the Work Group on the role and Status of Christian Educators. However, the course of the discussion showed many areas which caused a desire for clarification and additional information.

"Shall G-11.103n be amended as follows:

n. to ordain, receive, dismiss install, remove, and discipline ministers, to plan for the integration of new ministers into the life and work of presbytery, to establish minimum compensation and benefit requirements for all pastoral calls (G-14.0506e) and for all calls to Certified Christian Educators and guidelines for compensation and benefits for Certified Associate Educators employed by the churches of the presbytery (G-14.0705b(2)), to provide services of recognition for Certified Christian Educators and Certified Associate Educators (G-14.0705b(1)), and to find in order, approve, and record in the presbytery minutes the full terms of all calls, and changes of calls approved by the presbytery."

Social Witness Policy

---ov 00-74 (Donegal), APPROVED with amendment so that it reads:

"1. Definitions

"Entities of the General Assembly use the following documents to make a social witness policy:

a. A ‘policy statement’ establishes the fundamental principles that guide the denomination’s social witness. From this policy base a strategy is developed, a program is defined, and a personal social witness is empowered. The most current policy document produced in conformance to the requirements of 2 a-g of this document and adopted by a General Assembly shall be the policy in force. Any previous policies and statements, having been examined and considered by the group producing the new policy, shall be superseded by the adoption of the most current policy. When requests for policy statements are made, the most recent policy statement shall be given; however, past statements shall be included in full response to requests for information."

2. Shall 7.d. read as follows

"7. Guidelines . . .

d. The Stated Clerk and directors of divisions or related entities shall respond to emerging mission needs that require an ‘official’ Presbyterian social witness by explicating the most current General Assembly social witness policy."

Sexuality Resource Material for Ministry

to direct the GAC to have the CMD and NMD to do the following:

"1. survey congregations of the PC(USA) to elicit stories that will identify

a. ministries of outreach and evangelism that have been effective in reaching gay, lesbian, bisexual, and transgender members of their communities;

b. specific congregational programs ministering with and to gay, lesbian, bisexual, and transgender person, their families, and friends;

c. approaches of pastoral care that are sensitive to the particular needs of gay, lesbian, bisexual, and transgender persons, their families, and friends; and

d. lessons learned from successes and failures.

2. Consult with gay, lesbian, bisexual, and transgender members, as well as former gay, lesbian, and bisexual members of the PC(USA) in the development of the survey and the resources which are in conformity with recognized professional standards as directed by the 211th GA (1999)

3. Use the survey responses in the development of resources and tools to assist congregations in ministries of evangelism, programming and pastoral care with gay, lesbian, bisexual, and transgender persons, their families, and friends.

4. Make the resources available to all congregations, presbytery, and synod resource centers, and committees on ministry who request these materials.

5. Consult Scripture and the Confessions of our denomination

6. Report its progress to the GAC prior to the 214th GA (2002).

Sexuality Curriculum

That recommendation 1. be approved: "Allow the Curriculum Publishing Division to reprint the God’s Gift of Sexuality curriculum, as it was revised in 1998, until such time as a practical and thoughtful revision can be made, as is the practice for all good resources. APPROVED 353-158

That recommendation 2. be approved with amendment: "Instruct the Curriculum Publishing Division to send an interpretative insert sheet with an attached order card pertaining to Sexual Abstinence and the Abundant Life, with all God’s Gift of Sexuality materials ordered from PC(USA) so that congregations may adjust the curriculum to meet the needs of their youth and families. APPROVED 383-132

3. To direct the Curriculum Publishing Division [when Kirkpatrick read it later, he read "Congregational Ministries Division" instead] to move ‘with all deliberate haste’ to complete the revisions mandated by the 211th GA. The revised curriculum shall be presented to the GAC for review prior to the 214th GA so that the revised material will be ready for distribution by the end of 2003. APPROVED (motion to substitute this #3 for previous #3 approved 268-237. Item as amended approved 263-247.)

Abortion Policy

4. Direct the CMD to revise the "Guide for the PC(USA)’ to include the 1992 policy statements as indicated by the ‘Monitoring Report on the Implementation of General Assembly Policy on Abortion.’

Feminist Theologies

--CR 00-20 That the resolution be referred with amendment to the GAC.

1. Urges congregations and middle governing bodies, and directs the GAC and the three divisions (National, Worldwide, and Congregational Ministries) of the PC(USA) to engage in educational forums and dialogue regarding the relationship between Reformed theology and contemporary theologies of women.

2. Instructs the PC(USA) to cooperate in preparing and widely distributing educational resources that would be useful for study and dialogue in these issues.

3. Instructs the GAC to assess the denominational response to this study and dialogue and report findings to the 215th GA (2003).

PC(USA) "Special Interest Organizations" Reporting

---ov 00-49 (Hudson River), APPROVED WITH AMENDMENT 468-31

1. Direct the OGA and the Washington Office to communicate the GA’s strong support for the elimination of "soft money" contributions to political parties and for other campaign finance reforms, in order to increase public participation in elections and fairness in allocating the benefits and burdens of civil society.

2. Direct the OGA to request all special interest organizations that use the name PC(USA) in their names and distribute information to church members to provide, annually and voluntarily, the following data to assist commissioners and all members to weigh the influence of these groups:

a. The legal title, legal and tax status, date of founding, location of offices, number of paid staff, number of members if a membership organization, list of annual publications and their circulation within and outside the PC(USA); and

b. Total annual budget with all donors or organizations giving aggregate amounts of over $1,000 to be listed by amount (as in public campaign finance), with the donor data to be kept on file with a copy of each organization’s bylaws and/or charter at the OGA; and

c. A 300-word statement of the organization’s goals and methods, including its operations at the GA, in boards and agencies of the denomination, and in the denomination’s seminaries and colleges, and

d. A 300-word summary of the organization’s theological emphases and vision of the Church of Jesus Christ.

3. Direct the OGA to reprint the data submitted on the PC(USA) web site as an appendix to its annual report with a brief introduction by the Stated Clerk that

a. states the importance for the church to set an example for the world in mutual respect, accountability, openness, and fairness in deliberation; and

b. summarizes the outlines of the material received and lists those organizations not voluntarily submitting the brief reports.

W-4.9007. "Scripture and our Confessions teach that God’s intention for all people is to live either in fidelity within the covenant of marriage between a man and a woman or in chastity in singleness. Church property shall not be used for, and church officers shall not take part in conducting, any ceremony or event that pronounces blessing or gives approval of the church or invokes the blessing of God upon any relationship that is inconsistent with God’s intention as expressed in the preceding sentence."
